  • Our service is free to use. When you apply for a mortgage through our site, we receive a fee and/or commission from the provider.
  • It's your responsibility to ensure that the information you provide when using any of the sites is accurate and complete. If it isn't, a product or service that you obtain via our site may not be suitable.
  • It's also your responsibility to ensure that the product matches your financial needs.
  • If you proceed with a provider through our site, you will also be subject to the provider's Terms of Use and privacy policy (which will be different to ours) and you should read those carefully.
  • We may amend these Terms and Conditions at any time and without notice by changing this page, so you should check our Terms & Conditions each time you use the site.

Mortgage Clever is a registered Trading Name of TFLI (US) INC an Appointed Representative of TFLI Limited who acts as a credit broker, not a lender, and is entered on the Financial Services Register under reference number: 723630. 

TFLI (US) INC is authorised and regulated by the Financial Conduct Authority and is entered on the Financial Services Register under reference number: 946605. TFLI (US) INC is registered in the United States of America (Company number P20000059850). Registered Office: 1200 Brickell Avenue, Suite 1950 #106. Miami, Florida, 33131. Licenced by the Information Commissioner's Office, Registration Number ZB053626).

For the purposes of these Terms and Conditions, references to "we", "us", "our" or "Site" are to Mortgage Clever is a registered Trading Name of TFLI (US) INC is an Appointed Representative of TFLI Limited.

Definitions

In these Terms & Conditions:

  • Service means any service that we display on our site
  • Site means any mobile applications or other similar devices, channels, or applications operated by us and
  • You and your mean any person who accesses and uses the site

Your Acceptance of these Terms and Conditions

Access to and use of the Site is subject to these Terms and Conditions and our Privacy Policy. By accessing and using the Site you agree to be bound by and act in accordance with these Terms and Conditions and our Privacy Policy.

If you do not agree to these Terms and Conditions or our Privacy Policy, you should stop using and/ or accessing the Site immediately. 

Changes to these Terms and Conditions

We reserve the right to amend these Terms and Conditions from time to time by amending this page. The amended Terms and Conditions will be effective from the date they are posted on the Site.

Our Service Provides to you

As a credit broker, we provide an online service that allows you to apply for a mortgage with our panel of finance providers, mortgage brokers, and credit brokers. As a credit broker, we work with our partners displayed within our Privacy Policy shown within section five. We have no control over the panel regarding the acceptance of an application as this is subject to your financial circumstances.

You may access our service in the following ways:

  • Applying via our brands on social media platforms, for example, Facebook, Snapchat, Tiktok, and Google PPC
  • Applying through one of our partner's websites, where we work in conjunction with our partner and transfer you to our panel of finance providers, mortgage brokers, and credit brokers 
  • In order for us to provide our Service, you will need to complete the online application providing us with information about you and your financial circumstances.

Our partners may undertake a soft credit search with their credit reference agency. This is for the purpose of validating your identity, assessing your eligibility for the mortgage, and preventing fraud. This soft search will be recorded on your credit history but is not visible to lenders and will not impact your credit score.

If you don't want our partners to undertake a soft credit search you should stop using our Site immediately and not proceed with the application.

Application Outcomes


Upon the completion of the application, if you have been accepted, we will share details of the partner. We have no control over our partners regarding the acceptance of an application as this is subject to your financial circumstances.

Where we are unable to find you a partner, you will be informed accordingly and we recommend that you seek independent advice regarding your financial circumstances.  We recommend the help offered by https://www.moneyhelper.org.uk/en

Communication / Marketing

Unless stated otherwise, our panel of finance providers, mortgage brokers, and credit brokers will contact you via means of telephone, SMS, and /or email to provide information and alerts relating to your application and or services we think may be of interest to you.

Soft opt-in is an exception to the general requirement to obtain consent before sending direct marketing to you by electronic means (such as email or text message for example) and applies where you have previously engaged with us (for example by submitting your contact details on our website to make an inquiry about Our Service), and we are marketing our similar products and services. Under the 'soft opt-in', we will assume you still want to hear about our other related products and services until you opt-out or unsubscribe. For most customers, this is beneficial as it allows us to tell you about our other similar products and services that we think would be useful to you alongside the specific one you originally expressed an interest in.

Where you have applied using our site and our partner has accepted the application, we will receive a commission/fee.

All Intellectual Property Rights (including, without limitation, all database rights, rights in designs, rights in know-how, patents, and rights in inventions (in all cases whether registered or unregistered and including all rights to apply for registration) and all other intellectual or industrial property rights in any jurisdiction) in any information, content, materials, data or processes contained in or to this Website belong to TFLI (US) INC or its licensed source. All rights of TFLI (US) INC who is an Appointed Representative of TFLI Limited in such Intellectual Property Rights are hereby reserved.

You may print off a copy and may download extracts, of any page(s) from the Website for your personal use.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Jurisdiction

The Website & form is controlled and operated in the United Kingdom. These Terms and any non-contractual obligations arising out of or in connection with these Terms will be governed by the laws of England and Wales and you irrevocably agree to submit to the exclusive jurisdiction of the English courts.

Liability

To the extent permitted by law, we exclude all conditions, warranties, representations, or other Terms which may apply to the Website or any content on it, whether express or implied.

We cannot guarantee that our partners will accept the mortgage application. This may be as a result, directly or indirectly, of a systems problem, issues that are unforeseeable or outside of our control, or that of our panel of finance providers, mortgage brokers, and credit brokers, or because the information has been provided incorrectly.

We shall not be liable for any loss you may suffer unless we have been negligent or not acted in accordance with these Terms and Conditions or unless otherwise required by UK law. In the event that you do not use this form with reasonable care and in accordance with these Terms and conditions or we discover or are notified that you are using this form fraudulently, we, our partners reserve the right to charge you for any reasonable costs that we may incur in taking action to stop you using the form and recover any monies owed as a result of your activities.

Right to be Forgotten / Erasure of Your Personal Information

You have certain rights under the General Data Protection Regulations. For example, we will always let you have a copy of the personal information we hold about you if you request it from us in writing.

  • Right to be informed when we collect your data, we have to tell you what we are going to do with it primarily through this Privacy Policy and within the opt-in/consent statement.
  • Right to object - because you have asked us to help you find a financial product or service, we need to process the personal information you give us to enable us to help you find the best product or service available amongst to our panel of finance providers, mortgage brokers, and credit brokers. You can object to this processing at any time by sending us an email at compliance@tfli.us We will action any request you make promptly, although this will mean that we will not be able to help you find the financial product or service that you asked us to search for.
  • Right of access - you can ask us at any time to confirm whether we hold your personal information, and if so, you can access it by emailing us at compliance@tfli.us to our Compliance Department. 
  • Right to rectification - if we hold personal information about you that is inaccurate, you can ask us to correct it, and we will do this as quickly as possible.
  • Right to erasure - if it is no longer necessary for us to hold your personal information bearing in mind the reason why you provided it to us, you can ask us to delete it. If you ask us to do this, we will delete your personal information as soon as possible although this will mean that we may not be able to help you find the financial product or service that you asked us to search for.
  • Right to restrict our use of your information - you can ask us to restrict our processing of your personal information if you think for example that the personal information you gave us is inaccurate. This may mean that we may not be able to help you find the financial product or service that you asked us to search for.
  • Right to data portability - this gives you the right to ask a holder of your information to transfer that information to another business. This right would most commonly be used if you were switching banks, insurance companies, and utility companies.
  • Right related to automated decision-making including profiling - You have a right to object to automated decision-making, to express your point of view, ask for human intervention, and to be provided with an explanation of the decision with your option to challenge it.   • Right to complain to the Information Commissioner's Office (ICO) - we will try to resolve any complaint that you may have in relation to data protection issues. If you are not happy with our final response you have the right to have your complaint dealt with by the ICO. How we handle your complaint

Once you've made a complaint, the Compliance Department will log the complaint, send you an acknowledgement and try to resolve the concerns within 3 working days of receipt. The acknowledgement will include the name and contact details of the individual dealing with the complaint. 

We aim to resolve this as soon as possible usually within 15 working days issuing you with a final response. A final response must be issued within these 8 weeks, and we will always keep you updated on the progress of the complaint.

If for some reason we haven't been able to resolve your complaint within 8 weeks, or you're not satisfied with the resolution you can refer your complaint to the Financial Ombudsman Service.


What if you are still dissatisfied with our response?

If you receive a final response letter from us and you're not satisfied with the resolution, you can contact the Financial Ombudsman Service, you'll need to do this within 6 months of receiving our letter
